Erienet Usage Policy
You must be at least 18 years of age. If you are under 18 years of age, then a parent or legal guardian must agree to this service. The parent or guardian assumes all responsibility for the account. You are required to have a valid authorized account under your real name, containing true and valid information.
All accounts are strictly limited to one login at a time and may not be shared among friends or neighbors. Accounts are setup for occasional usage and are not to be used as dedicated service. When you are not using the service, you need to disconnect so that others may use the service. Dedicated dial-up services are available for an additional charge. Individuals discovered to be abusing this restriction will face a temporary suspension of services or total termination of their account.
You are responsible for verifying that the phone number you are calling the Internet through Erienet is a local access number to which your computer is dialing. Any telephone charges associated with your access to the Internet through Erienet are solely your responsibility. Erienet makes a best effort to provide access numbers that are local or extended local, however, we cannot guarantee that your calling plan with your telephone company will allow unlimited dialing to our access numbers or will not charge you a fee to dial our access numbers.
ERIENET DOES NOT REIMBURSE OR PAY ANY TELEPHONE CHARGES FOR ANY REASON.
All unlimited usage accounts are afforded 5 mailboxes and 100MB of disk storage on the Erienet computer system for posting of a personal website. Visit our Technical Support Website at http://support.Erienet.com and click on the link "Multiple Mail Accounts" for setup instructions. Personal websites are limited to personal usage only, posting of commercial websites (including not-for-profit organizations) is prohibited without prior written permission. No websites may contain any obscene or offensive materials. Erienet personnel will review all personal websites for content all will restrict access to any account that violates these terms and agreements.
Any use that disrupts the normal use of the system for other customers is considered to be an abuse of the system and is grounds for administrative intervention. Some examples of system abuse include spawning excessive processes, consuming excessive amounts of memory or CPU for long periods of time, and staying attached to modems while not really "active" on the line.
You are responsible for safeguarding your account and password. Erienet can be reached from any site in the world, thus password security is of crucial importance.
You may use your account only for lawful purposes. Transmission of any material in violation of federal, state or local regulations is prohibited. This includes, but is not limited to: copyrighted material, threatening or obscene material, or material protected by trade secret.
You may not engage in unauthorized duplication, alteration, or destruction of data, programs, or software on any local or remote system. You agree to indemnify and hold Erienet harmless from any claims resulting from your use of the service which damage either you or another party.
You may not use computer resources to engage in abuse of local or other network users. This includes the transmission of obscene messages and the like. You may not use computer nor network facilities to attempt to breach security on any local or foreign hosts.
ANY activity of this sort shall be grounds for the immediate termination of your account with Erienet, as well as the full disclosure of any and all information relating to this matter to the proper law enforcement authorities for criminal prosecution. The use of computer and Internet network services are subject to federal and state regulations, with which you are expected to be familiar. These local guidelines, which include federal and state regulations, of computer and international network usage are subject to revision. You as the user are expected to be familiar with any modifications and/or revisions in the laws and regulations.
Use of any information obtained via this service is at your own risk. Erienet specifically denies any responsibility for the accuracy or quality of information obtained through our services. Erienet does not warrant that its service will meet any specific requirement you have, or that it will be error-free or uninterrupted. Erienet shall not be liable for any indirect, incidental, or consequential damages (including lost data, information, or profits) sustained or incurred in connection with the use, operation, or inability to use the service, whether caused by Erienet's own negligence, or by your own errors or omissions. Erienet makes no warranties, expressed or implied, as to the merchantability of the service or its fitness for a particular use or purpose.
Erienet may cancel your account at any time, for any reason, including, but not limited to, violation of any of the terms set forth herein, or in Erienet's definitive statement of terms and conditions referenced below.
You agree to pay for this account according to Erienet's billing policies. The Erienet accounting cycle begins on the first of each month. All accounts are automatically renewed at the end of the billing cycle unless you place a cancellation order in accordance with our cancellation policy at least 7 days before the end of your billing cycle. If we do not receive your payment when due, your account may be terminated. Termination of your account does not remove your responsibility under this agreement to pay all fees incurred up to the date of termination including, but not limited to, collection and attorneys' fees incurred by Erienet. If you decide to cancel, you must call our office during our normal business hours and speak to a representative who will issue you a cancellation confirmation number. Cancellations must be made at least 7 days before the last business day of the month. All cancellations will be effective the last business day of the month or the end of your prepaid subscription term. Cancellations will not be accepted by any other means. Non use of your access account does not relieve you of your obligation to pay for your account service.
Charges for new accounts are prorated. Charges for terminating accounts are not prorated. The account holder acknowledges responsibility for the account until payment in full is made. If your account is suspended for non-payment, there is a $10 fee for re-activation. Termination of an account due to lack of payment does not remove your obligation under this agreement to pay all fees incurred up to the date that the account is canceled, including any collection fees incurred by Erienet. There is a $30 charge for returned checks. There is no refund available for unused portions of monthly or annual prepaid services.
You agree to read and abide by the definitive terms and conditions of service (which may be modified at any time without notice), published on the World-Wide Web at http://www.Erienet.com/agreement.html. If you do not agree with the definitive terms and conditions, log off and contact us. These terms and conditions supersede all previous representations, understandings, or agreements, and shall prevail notwithstanding any variance with terms and conditions of any order submitted.
